hey folks today we're going to be taking a look at a couple of websites that will help you to do some logo image searches now there's nothing worse than creating a logo concept or even taking a logo to a final design stage only to find that someone else is either using the logo or it's been registered as a trademark it's a big waste of time and potentially a big waste of money so one thing that i do when i'm creating logo designs is when i get to the stage in the design process where i'm happy with a concept i will go and search the internet to see if there are any logos which are exactly the same or very very close to the concept that i've created now there are a couple of websites that i use to do that one in particular which helps me actually check to see if the logo is a registered trademark so let's jump in and let's take a look at a couple of logo designs and see what results we get on each of these websites so the first website that we can use is good old google and you want to choose the image search option on google so if you go to google.com uk or google.com whichever is your base google home page if you look up on the right hand side in the window you will see a link that says images so if you click on that you will get a new window and there's a little camera icon if you click on search by image it will open up this window and what you can do is you can drag in an image from your desktop or you can upload the image or you can even paste in a url from an image which you find online so i have a couple of logos off to the side here uh the first one i'm going to choose is the nike swoosh so let's drop that in and see what results google gave us so no surprise there but google has picked up that it is the nike swoosh and it's showing a few options there and it's giving us some links through to those pages the next site that i use is 10 i i've used that for quite a few years i find it can be hit or miss a bit like google to be honest uh sometimes it picks it up and sometimes it doesn't which is why it's another reason i like to use more than just one site when i'm looking for image results so let's pull the nike swoosh into here again you can just drag it in or you can upload or paste the url and like google tni has pulled up the nike logo with links to websites that we can go to and check out for more information and the last website i'm going to show you is the wipo global brand database now this is a site that i use a lot because it covers all of the countries that have trademarks and its database is fairly comprehensive you can search for a simple name so if you're looking for if you're thinking about changing a name or creating a name for your business you can go into here and over here on the left hand side of the page you've got search by you can put in you can type in a name and it will search to see if there's a trademark with that name i actually have a video where i show you how to do that process with a couple of different filters and you will see the link for that at the top of the screen now i will also include a link to that in the description of the video the one that we are interested in today is on the right hand side which is the filter by section and it will be on source when you first get here but if you click on the image tab you will see some options over here for doing an image search so we've got concept which does a search for images determined by the artificial intelligence to contain similar concepts to the image that you upload with shape images with similar lines similarly distributed through the image it ignores any color that you have in the image that you upload then we've got color images with similar colors similarly distributed throughout the image less accurate on the shape side of things so if color is important then that's the one that you probably want to filter by and then you've got composite which uses all of the ones above but again it's a little less accurate because it's trying to kind of fit it in with everything so generally the best thing to do is i will do a search under each of these for the same image just to see what results come up and it gives quite a good intensive search that way and you also have an image type so if it's text you know if it's a word mark you can click on verbal and it will look for uh it'll do a search for images that contain text you've got non-verbal so icons are graphics then you've got combined so you could have an image and text and then you can just choose unknown and it will just kind of do a search there on its own so you can see here that the wipo search is a lot more comprehensive than google or 10i in that with google antenna you just drag your logo in and it just automatically searches the web with wipo website it does a more comprehensive search and searches for trademarks in its database so just to make clear wipo searches it its own database it does not search the internet so with the results in wipo you will be getting results from registered trademarks there may be logos out there which are similar to the design you've created but might not show up in a google or 10i search and if they're not a registered trademark then they will not show up in the wipo search either so as much as you know i'm using these three sites it's not comprehensive but it does give you a good indication whether or not you know you should proceed with that concept so again let's drag in the nike logo and we've dragged that in now and we're going to choose shape for this one and we're going to say it's non-verbal and then what you do is you go over to filter and just click on filter so you can see here that it has brought up lots of swishes now i'm using the grid search here because you can see more images in one place there's a little uh set of options here list view and grid view if you click to list view it shows all the logos down the right hand side and gives you all of the information the brand name the who holds the trademark the company whether it's active or inactive so there's a lot of information there you can also click on the uh line in the column or the image in the grid and it will open up even more information now one thing that can be frustrating is once you've looked at this information do not click back on your browser back button because that will just take you out of the search you want to click on this little back link here that will take you back to the search results that you were in so we can see here by going through wipo 10 i and google that the nike swoosh comes up and it's really clear that it's there so you wouldn't want to create a logo which is similar to the nike switch so let's do a couple more searches using some famous brand logos and then we will do a search with a logo concept which i have developed so we want to go back to the image search so we'll get that open and i'm going to pull in the gucci logo this time and see what google does with that yep straight away it's brought it up it's given a possible related search as well so vector gucci logo and you can see here we've got some images and some web page results as well we'

airplane wine or airport one depending on where i stop so maybe i can join you all for a virtual toast we'll see anyway my name again is nicole gaither i'm the owner of creative ip law a boutique trademark law firm we work with clients all over the country to help them register their trademarks and with any other issues that they might have with trademark registration or with you know doing trademark searches and also we work with clients who are not in the us but are trying to register their trademarks in the us so welcome again to tipsy tuesday i hope you all are enjoying an outstanding glass of wine on my behalf i will try to join you all for virtual toast if possible if the time is right so tonight's topic is how to do your own design mark search and a design mark is you know think of a logo like the nike swoosh it's a logo or graphic that you use to represent or to help your customers identify your brand um so it could be something that you use just you know it could have words or it couldn't um it's just basically like a graphic representation of your brand so this is you know like most people refer to it as a logo some people use it a design or they call it a graphic but it's just something so like if you see this is our newest logo i kind of designed it myself i used canvas so just to note if you are using canva to design a logo you cannot register the trademark for that logo because canvas license does not allow you to do that so just keep that in mind if you are going to use canva to design your logo you will not be able to protect it via trademark registration or even copyright registration because those are their designs but if you have someone design a logo for you which is great because hopefully that is a unique uh graphic then this would be definitely something that you want to pay attention to and use on your own so let's get started so let's see we're going to check out i'm going to do all right so we're going to use the uspto's website and i'm going to cue it up here all right so we're gonna go to it's uspto.gov trademarks and this brings you to the trademark page and scroll down because there's a lot of information here like of course you know pay attention uh all filings are now electronic for trademarks and you're also required to have a us license attorney to follow trademarks so we're going to go to search the trademark database so this is the trademark electronic search system the test system so click on search and last week if you were with me we did a word mark search this is like for the words for your business name or your product name and we just did the basic walmart search so if you're going to be doing a search for a design you want to either use the word and or design mark search the structured search or the free form now i think i mentioned last week that if you use the free form you better know boolean logic and you know if you know all that that's great so i'm going to show you kind of example of what you would need to know like these are all the field codes that you would need to put in if you were using the free form search we're going to do it the easy way and use the structured search so let's pretend like we're going to do a search for my logo which i said again i can't register it because i use canva to design it but let's just pretend so like remember when we looked at my logo which i'm going to pull up again for you all as you can see i have a light bulb here with like circles looks like a little galaxy it's got stars a circle and a square um and a pen that kind of goes and lights up the light bulb so let's say we're going to do a search for the light bulb itself so let's go back to our uspto website we're going to go to the structured search and before we go here actually this is what i wanted to show you all so you have to use the design search code manual to look up the design codes because that's how you're going to do your search and you can do it uh alphabetically so let's look for and like here is the list of like everything that is going to have a search so we're going to look for the light bulb first because that's going to be like the main part so we're going to scroll down look for light bulbs here we go light bulbs electric and just you know as you can see there's other things like light rays light houses lightning lightning bugs so light bulbs electric so it does not include ceiling fans so electric light bulbs fluorescent light bulbs uh as you can see i'm scrolling up it's like flashlights those things so of course it looks like our search is going to be using design code 130113 so write that down make a note of it i'm going to copy and paste it so we're going to go back to our search and we're going to the structured search and i'm putting in that number in my search term and i'm going to go to the field design code and then click submit query you can see all of these there's 4 345 records that have that as a design code so i always look and cheat a little so what i do is i go to the image list so like as you can see these are live trademark applica applications so these are ones that are pending so they're in the process they've been filed but they haven't been registered yet um if it has a registration number next to it like this one right here that means that it has been registered so let's take a look at that one so they're using a light bulb that looks almost like a robot that's very detailed now as you can see here is the code the 1301 13 for bulbs electric light and flash and they also have like they're designed for men for blood vessels cogwheels brands um other bands so you know those are something that we might need for ours if i were to register mine so what i do is i kind of do i look at the image list so this actually shows you pictures of the um the images the logos that are being you know applied for for registration so you can kind of see from here and you can look and see if there's something that's similar to what your design looks like so there are a lot of different light bulbs here um really interesting nice looking ones here so this gives you an idea of how to do the search for your design code and you're going to do it based on the items that are in your logo so if you have like mine i have the light bulb so i need to do a search for the light bulb i also need to look for you know light bulbs that might have pins light bulbs that have pens with you know a like like bands around it with like a star or you know a square so that is how you do a design mark search using the uspto's website um so you just want to make sure that you're not using symbols that others are using in the same industry and if you are you want to make sure that yours is very different there's no chance for confusion so that is why you do the search so preliminary search just to make sure that the logo that you are using or want to use is not going to be one that someone could say that you've
