what's up everybody this is attorney dan and today i want to talk about trademarks and whether a trademark application can be amended uh and the answer is yes with the but so it depends what type of uh amendment you uh need to do typically at the general rules you you can't um if you're looking to change the mark then uh you can't maturely alter the mark um and what does that really mean and it's kind of partly subjective and this is where you have to go dig into the rules a little bit but i kind of just give you an example recently i had and um it was in my file uh the the applicant came in asking for my help but um they filed for a standard word mark and then the uh then they um then they switched it to um a logo and the examining attorney said no you can't do that because that is a um it has a material alteration right you can't maturely alter it and so so typically like uh if if it's like missing an apostrophe maybe if it's missing a letter unlikely um but so really just kind of depends on what the modification or the amendment is if you're looking to change the mark itself also sometimes you can sometimes you can't okay other other things you may be able to do is like you know if it's like an address or you need updated yeah you can you can do that but for a lot of a lot of um or you're asking like hey can i can i add new classes to the um to the goods and services and the answer is no so typically you can't go broader like you can't add classes or expand your description of goods and services but you can go narrower so here's a kind of a trick for your for us long time practitioners what we do is we try to go as broad as possible because it's easier to delete classes or go narrower through the examination process than it is to to go wider so you start off narrow you can't go wider okay and so uh to answer the bigger question yes trademark applications can be amended but um the lawyerly answer it kind of just depends what you're looking to amend and sometimes you can depend sometimes you can't depending on what you're exactly amending for so hey this is dan if you need help with your trademark application or you just don't want to deal with all this on your own feel free to reach out to us we happy to book an appointment with you and see how we can help you all right this is dan talk to you soon bye
