hey everybody my name is marcela dominguez and if you are new here i am trademark lawyer marcela helping small and medium-sized companies register their trademarks renew their trademarks protect their trademarks which usually means your brand name your tagline your logo or your slogan so make sure you hit subscribe i can't wait to talk to you today so in today's video i am talking to you about something that i've already talked to you about in a previous video now if i talk to you and i sound like i'm running out of breath it's not because i don't want to be talking to you but actually i am inviting you to join me on my workout today you see for new year's my resolution is to exercise more than i did last year so that means that i might have to be killing two birds with one stone exercising and pumping out some of these youtube videos talking about trademark laws and making sure that you know more than you knew before you started watching so thanks for joining me in my workout today i'm going to be talking to you about something i had already mentioned in a previous youtube video and that is uspto price increases in 2021. uspto if you don't already know stands for the united states pan and trademark office so if you go to uspto.gov that's where you're going to find all the information you need to know about registering a trademark now the reason i created this trademark lawyer channel is because sifting through a lot of that information can be time consuming can be really boring if i'm honest and can be kind of tedious for somebody that's not used to reading that type of language and somebody who doesn't want to waste their time sifting through all that information because if you're a business owner then you're either going to have time or money but i digress and i'll talk about that in a different video the point of this video is to talk to you about uspto trademark price increases i told you guys in a previous video that price increases were coming and guess what price increases are here the uspto clearly didn't waste any time in increasing prices because as i'm recruiting this video it is january the 4th 2021 and over the weekend i tried filing trademark registrations for some trademark clients and guess what the price increases are here so last year you used to be able to file an application that was 250 or an application that was 275 the application that i used to file last year was 275 and so what you're able to do with that 275 application is that you're able to customize your identification of goods and services so if you choose the lesser expensive option then you have to select from a list and there's like a million and one things that you could choose from in that list so like for example if you are an online retail store and you plan to sell merchandise sweatshirts hoodies t-shirts socks all that sort of stuff then you actually have to go find sweatshirts t-shirts hoodies socks hats you have to go to that list find everything and literally check the box mark the box for each and every one of those goods that you currently sell or that you plan to sell for an intent to use application and so for the application that i always use that last year cost 275 dollars and that's always been my favorite one and i mentioned that in one of my other videos so click on this link right here where i talk about that application a little bit more but i love that application because the 275 option because you are able to type in whatever you're selling so instead of actually having to tick boxes you could just write you know online retail store services namely you know sweatshirts t-shirts hoodies and everything that you've already checked in the box so it's much much more efficient and so for lawyers that already know well i shouldn't speak for every lawyer i don't know i don't want to make the assumption that every other lawyer even every other trademark lawyer is going to automatically know what to put in the description but i know from experience and from the research that i do i love to type in my description because like i said it just makes it more efficient makes it easier for me i don't get frustrated along the way because then i can move on to the next piece of the application quicker but anyway so that 275 option has gone up to not 300 not 325 but up to 350 per class so the trademark office is now charging you 350. for the application fee and it used to be 275 and you're still going to be able to type in your description like i like to do but now it's going to cost you 350 per class so that means that it's a 75 price increase so you do the math if you have more than one class then now you're going to be paying 75 more per class so if you're somebody that wants to include a lot of classes then just make sure that you take that into account in calculating how much you're going to be spending with the uspto or if you're hiring me my prices actually have not changed since last year so if you're interested in me helping you then you're in luck lots of lawyers they do that every year they increase their prices and i will probably do that at some point but i cost option then make sure that you visit trademarkanything.com where we walk you through a very very easy diy trademark registration and it's like the lowest costing we have so just make sure that you know what you're getting into if you use the uspto website because you're going to have to sift through a lot of verbage but the good thing is that they tell you from the very beginning what it's going to cost you so in the fine print it'll say are you choosing to register a trademark and the cost is 250 are you choosing to register a trademark application that costs 350 so if you choose a 250 option you're gonna have to choose from a list and also if you don't happen to meet the requirements of the 250 application then you can be charged if there is an issue for the extra hundred dollars if you mess up in some sort of way so just make sure that you read the instructions on the 250 option so you know exactly what you're getting into when you choose a 250 option but it's not gonna tell you you have to select from a pre-approved list of classes and so that's also why i love the more expensive option not because it's more expensive obviously but because in the example that i gave with clothing i mean that's really straightforward and that's really simple i mean it's simple to just choose sweatshirts t-shirts everything from class 25 that's really easy to choose but when you start getting into more complicated identifications like i was doing one the other day and i thought oh my gosh there is no way oh yes like for a non-profit organization that offers a number of services oh how much does it cost in u.s. PTO fees to file a trademark registration application well it depends on a few things first it depends on how you file the application specifically how you choose the descriptions of the services or the goods that you're going to use the mark with that affects the fee into one of three different application types that the USPTO has defined or for although paper filing is about to go away second it depends on what the use basis of the mark is have you started using it in commerce or you apply in on an intent to use basis and third it can also depend on how many classes you file in it not at filing because the fees are per class but later if you seek to divide the application into a number of different applications by class each division that creates a new application carries a fee so the first categories of fees depends on how you file if you file and you select the description of goods or services from the USPTO as long list of goods or services then your application can be considered T's plus teases the name of the application website and program that the USPTO uses at T's plus it is currently $225 per mark per class of goods or services if you have to write your own description of goods or services then it's T's RF RF for reduced fee that's two hundred and seventy five dollars per mark per class if you file and your application is T's regular then it's four hundred dollars per mark per class and if you file in paper then it's currently six hundred dollars per mark per class but note that as of February 15th which is a week from now or not even five days from now then paper filing is no longer going to be an option ones paper filing is no longer option then you'll just have the three different teas fee statuses 225 to 75 or $400 per mark perk lots check back soon for another video on what the trademark fees are for intent to use status and use in commerce status if you've got questions about teas the trademark electronic application system or the fees please leave me a comment DM me you can email me hello at yah spin law comm or shoot me or give me a phone call six one seven three four zero nine to nine five my email is hello at yah spin law calm thanks and take care
