yeah what's good farm welcome back again to our family meeting should i call this a family meeting or yeah because almost everyone watching my video i tend them to be my family now because yeah they've been supportive contributive productive what other word can i use yeah guys so welcome back again to my youtube channel yeah i know it's been a minute yeah it's been a while since i posted i think um last week i posted just three videos and um i wasn't able to post i was busy you know what i mean i tried trying to make time for myself trying to manage my time trying to manage work and some other stuff yeah so man has to do what man has to do yeah so i've got some few updates here that is um from training dates i mean for volunteers uh entry requirement into qatar that is for both international volunteers and international funds accommodation for international volunteers finally so yeah and um oh so there is um one new thing here that is um it's called the oneplus 3 policy yeah oneplus 3 policy so stay tuned let's get into today's video yeah so let's talk about the training date yeah i know um most of the volunteers have been i'm worrying too much you know but one thing that i keep on telling them is as far as you've been selected among these um 80 000 people who applied for this role and among the 20 000 people who are selected and you happen to be among that 20 000 people who are selected sleep my guy when you sleep sleep you know because you've made it you've made it like yeah you've made it among these 80 000 people who apply you i mean you've made it so just cut yourself some slack you know don't don't stress yourself too much like yeah but sometimes i can understand i mean the international volunteers i can understand your frustration because you know the only means and ways people communicate to us is through our porthouse and um through through our mails but sometimes this may take um quite some time to you know get to us and sometimes we wonder like uh we wish we could have direct means to fifa where we can extract um extra information from but sometimes you know it um even myself myself sometimes uh it's it's a bit frustrating um frustrating to me sometimes yeah so um you know we've we've already finished with a role offer everyone has received their rule of this well some of them are still pending i mean um fifa said until the end of september they will still be dashing out rules or be dishing out rules so let's wait and see for those of you who have not received your rule of this yet um sorry sorry sorry about that but let's just pray and still you know what i mean let's keep our fingers crossed who knows you might get your ruler for today tomorrow or something and also with international volunteers who have already received their rule offers or i mean both local and international volunteers who have already received their role offers a guy if you sleep fifa is going to take that roll off from you trust me that is why i keep on telling people to keep on checking their portals and their meals because um the least mistake the least chance someone is already i mean someone is ready to take your position so guys may i like keep your toes on the on the ground at all times don't don't don't don't even think of missing uh an email or missing any confirmation that fifa was sent to you so now that we've finished with the role of we're gonna head straight to the shift selection now okay i'm going to say this not because i've realized the supreme legacy committee or blah blah blah are the ones managing the volunteer i mean volunteer department for this world cup now i've um i've been part of two fifa events okay and some other events that um were all managed by the fifa and um they went very smooth you know if you may ask me yeah i mean i have friends that i'm like do you know why this time around things are so tense and we don't even get proper responses and proper information is from fifa when we try to reach them i think it's because this supreme legacy committee is handling or managing things i mean forgive me supreme committee or i mean i'm not saying this to to um dent your image or try and put some dust on your work but okay so early early this year during the um balloon festival that we had at cornish yeah i was part of it most of my friends were part of it and uh most of my friends uh friends that were with me during the during the arab cup or during the club world cup so these people noticed the difference i mean uh when it comes to how people manage things they they realize how fifa managed their own things and they also realized sometimes it takes things like this to realize um who's doing it better you know i mean maybe for supreme legacy committee i i i don't know them that much but well so for the first time i heard their names was um during the balloon festival and um i don't know i think okay so let me just pardon them because maybe probably it was because that was their first time you know and um yeah of course there might be hitches and sort of things that will um cut you at a point you know sometimes things like that so uh the the delivery maybe in the eyes of people it looked it looked beautiful i mean but people like us who operated the whole event and things like that we realized it wasn't it wasn't that deep it wasn't that powerful their management wasn't that you know and i don't know so since i realized they were the same people who were going to manage the volunteer this time around in the world cup i was like well maybe they can do better so supreme legacy committee uh they're the ones handling the volunteered thing now and um i find it you know yeah so i'm not even here to talk about them so just like i was saying now the shift selection i think about two three days ago most most of us i mean for those of us who have been very i'm consistent with our emails and our portals yeah most of us realize uh there's been a shift selection on our portal now i for one i checked the shift and the shift selection um they were giving me uh ceremonial something something i called one of my friends i was like yo me i cannot go and stand in front of this whole people and be dancing and be wiggling my ass you know what i'd be like yo it's it's not a bad thing but you know most of us don't have the courage do you know how many balls i had together to even do youtube like yeah it takes that courage and um i can't risk another courage to go stand in front of this i mean i can volunteer i can talk to people i can you know direct people if some of them misbehave i can be like yo do this and that but to stand in front of people and hide hide my pains hide my sorrows and be just dancing as if nothing has even happened yeah that was just by the way so yo shout out to other other ceremonial crew all the ceremonial squad yeah joseph is there just if it's my boy yeah so uh yeah we got the shift selection and it was it was about ceremonial something something like that but just like i said i i personally did not accept it even though i i raced i risked i risked i risked because i i knew what fifa is capable of hi this video is about use requirements in the US and in Europe so i'm joined by eric Payton who is a partner with Eric pertinent associates in Falls Church Virginia just outside Washington DC and we are talking about the use requirements in the US as compared to Europe so thank you for being on the video oh it's my pleasure to be here and we're in sunny Orlando Florida where we just wrapped up the int a annual conference and had a great time yes we did so in Germany or in Europe we can use trademarks we only have to use trademarks five years after registration and we can get trademarks just registered without any use and actually trademarks we're not really like fall from the register if you don't use the trademarks they can just not easily be enforced and the situation in the u.s. is very different tell us more right in the US generally you must have use to complete the registration process you can file an application based on an intent to use or of course actual use if you're already using it but even when you file based on intent to use you eventually need to show during the course of the application process that you have used the mark in commerce with all of the goods and services in order to get approved and complete the registration but applicants in the US do have a considerable amount of time to show that use because once the application has been approved initially and published in the public record you can then take up to three years to create that use and to demonstrate it right that is very different from Europe and Europe the situation is the way that you can file for an application or even in Germany and then the registration editor then the application would be a registered at some point and then you can just enforce the trademark even without using the trademark you can have a trademark registered and go after infringes for at least five years because five years after the registration the defendant in any case can attack the trademark for not being used for the registered goods and services but that's something that has to be done by third parties so you don't have to actively prove use to the office so it's very different and that leads to some complications in some really strange problems some of the larger applicants especially they fire the same trademark for example the telecommunications corporation orange they are filing the trademark orange every four or five years for a number of goods and services that they are never intend to use really and then they enforce the trademark against others that are using these very different goods and services and that can be sometimes considered fraudulent but actually the court sided with the applicants there was a recent decision by for the fountain pen manufacturer pelican at the European Court of Justice where they fired the nearly exactly same logo for they are M for their logo and also for things like travel services or something like this and they enforce this trademark for EM services that they were not really using and then the defendant tried to cancel the trademark but the trademark was not cancelled because the European Court of Justice in the final instance said where the logo changed a little bit over the years and it was completely non fatherland basically to reregister the trademark every couple of years for even very different goods and services and enforce it so that was a little bit surprising to many and very different from the u.s. that would not happen in the u.s. right right this is very different in the US where our entire system of Rights is basically based on use and even if you don't have a registration in the US but you have been using the trademark in commerce you have rights what priority common law rights that you could enforce against somebody who either tries to register the same you know similar mark for similar goods and services or attempts to use the same mark for similar goods and services and this does create a lot of confusion between clients that expand abroad and then notice that somebody may have registered something in another country in Europe for example and may not be using it but the fact that they have that registration you know obviously is problematic because they have rights that they are likely able to enforce and it also creates some confusion for businesses from Europe coming to do business in the United States or wanting to file to protecting the united state right without you so this is a good dialogue to understand better about these differences and the u.s. is one of the few systems in the world I believe that is based on usage more common most countries are based on similar principles to the European ones yes and but I actually sympathize with the u.s. system because then these fraudulent strategies would not really exist so what kind of use is required in the US my understanding is that trademarks work answered in the past for for fraud when they were when the applicant did not really show use for different goods and services of the mark and then the whole mark was was cancered basically but the the case law changed a little bit right which we got to fraud so it has evolved a little bit and now the main concern is which products or services are you using if you're not using them with all of those in the registration so you can either delete some from the registration proactively or when you go to renew it if you're no longer or never were using it with some of the goods and services because you have to sign a declaration regarding use you should delete those items that no longer in use the types of use in the United States that satisfy the requirements generally there have to be sales and for services generally advertising is sufficient to show that you so it could be a poster or a web pages you know the most common these days the easiest type of market for products it's a little bit more complicated for products the best types of uses are on the products themselves or on the labels or the tags that are affixed or attached to the products where it gets more complicated is when you have a product but then trademark or the logo may not be on the product itself but it may be on a sign advertising it or on a web page advertising it the Patent and Trademark Office generally does not accept that type of use because it is not on the product itself there have been some discussions about possibly expanding what type of use is acceptable but for now that's it needs to really be on the product or the label or the packaging or the instruction manual unless it's a very particular type of industry like for example I had a client once that made cement and because cement comes out in a liquid form all the time there's never going to be a trademark on the cement so in that type of instance the trademark on the truck that delivers the cement or on the sales information that they provide to their customers in that type of situation that type of use would be acceptable yes and my understanding is that the USPTO also really loves packaging for her as a proof of useless yes and my understanding is that you only have to show use for one
