because we got those trademarks in which is really cool i'm going to open these in just a minute but i also got letters like these from the world patent and trademark service the world trademark register the us trademark compliance office the world organization for patents and trademarks that sounds official and a few other letters too and the truth is these are trying to take your money and this is this is just a scam i mean you don't need to pay the money that they are asking you to pay so what i'm gonna do is open these letters and show you exactly what they're trying to get you to pay for and show you why you don't need to pay for them and it's important to file for trademarks right to protect yourself and protect the name of whatever it is you're creating but it's also important to know what's coming so the whole goal of this is to make sure you don't get duped i'm gonna put this down because it looks very dangerous all right so check this out we're here at the united states patent and trademark office and there's a whole section on making sure you don't get fooled by potentially misleading offers and notices and i'll link to this in the description but you'll see here that there's a whole list of examples of potentially misleading offers and they act and they actually ask you if you find new ones to put them on here so we can know exactly what to look out for i mean this is crazy these companies are set up just to take your money because they know that you're vulnerable during this time you've just created something official like a trademark and you want to protect it you might see this also when you file for names of different companies or dbas or perhaps you know other legal related things this is a time at which they know you're vulnerable and they're trying to take advantage of it but don't let them fool you come to this website the link is below in the description you can verify that these notices that are coming in and really there aren't many that are going to come in that are not coming from the united states patent and trademark office i mean so let's open some of these actually this one here you can see it says 2017 trademark notification inside response requested like how official is this sounding and it's like really pressuring me to want to make sure that i do whatever this thing says so let me take this guy and open this up and i'll show you and i'll read and i'll we'll actually see how much they're actually wanting me to pay so a little envelope so i put my money in there and send it to them all right so let's look at this u.s trademark compliance office important notification regarding your federal trademark trademark owner information for industries which is true serial numbers all this other registration stuff and then processing fee 495 and of course a lot of fine print here and this is for the trademark power up podcasting which is one of my courses and of course i can just detach this and put my 495 dollars in there and if i didn't know any better i would likely do this there's also some terms and conditions and you know is this legal i mean i can't say i mean i'm guessing it's not but they could be offering specific services but services that aren't required for you to have and own your trademark and do what you need to do with it i mean this one here which is the u.s trademark compliance office i'm going to scroll down and see if this was uh this one's in is on here u.s trademark compliance office from wilmington delaware wilmington delaware yep this is the exact same one so i'm going to click on that boom that it's the exact same one hey my fee went up this one says 425 they want me to pay 4.95 what's the deal with that let's open another one of these so that's that's one of them for about 500 bucks this one also includes an envelope wow okay this one for power-up podcasting my world mark um nine hundred and eighty dollars so that's already like fifteen hundred dollars that i don't need to spend and obviously this is uh the due date was last year and so i definitely didn't do that and i am not in trouble so um just the whole purpose of this i'm not even going to open the rest of them it's probably over four or five thousand dollars worth of notices that i've gotten just for this one trademark alone do not be fooled again if you are filing for a trademark go to the link that's in the description to the united states patent and trademark office and just verify that that notice is actually something that isn't real and um i just want you to be safe so you know you're trying to build your business i mean this is just sad that these kinds of people exist but we have proof that this stuff is not real so i should put this down again i'm getting a little bit no let's let's open the the real one so this is coming from my attorney and this is the actual patent and this is not patent but trademark and this is what it looks like so let me open these and i'll show you see this this is what is really cool united states of america power up podcasting and with the registration number and all that good stuff um this is this is what we need this is what will protect my name and the name of the course in court if i should have to go to that level and it gives me the power to find somebody else who may have and be using the same mark and you trademark engine is what's called the standard package it costs 149 and consists of everything in the basic package plus one a customizable cease and desist letter to a template trademark transfer and assignment form and three six months of trademark monitoring i assure you that none of these three items are worth the extra fifty dollars what if the uspto rejects your trademark application and refuses registration of your trademark should that happen all three of these items would be completely worthless to you you'll have no need for them and you'll have paid fifty dollars for no these three items worth the extra fifty dollars absolutely not let's start with a customizable c synthesis letter as a trademark attorney who has sent dozens if not hundreds of cease and desist letters on behalf of my clients i can tell you that there's no such thing as a standard c synthesis notice every situation is unique and requires an individualized approach but even if that wasn't the case what's more important than the letter itself is knowing whether it's in your best interest to even send a cease and des cease and desist letter and what the possible consequences of sending such a letter might be unlike trademark engine an experienced trademark attorney can explore those issues with you and prepare an appropriate cease and desist notice if necessary similarly there's no such thing as a one-size-fits-all trademark assignment a trademark assignment is an important legal document that must be carefully tailored to meet the needs and objectives of the parties entering into the assignment it makes me very nervous to think that people are using the trademark engine assignment form to transfer ownership of one of their most valuable assets without obtaining any legal
