hey guys lela here your ip attorney so today's question is can you register as a trademark a hashtag or a qr code well the very short answer is that the uspto strictly prohibits registration of a hashtag especially for those hashtags that are merely functioning as a hashtag where you are using it to search the internet to find other things that are tagged with that hashtag but i think that a workaround may exist where if your logo or your company name truly encompasses a hashtag and it's like a heading on your website and it's part of your logo and it's truly part of your branding i think that that's a workaround and you could argue that it's functioning as a trademark and therefore get it registered but like i said it's a creative solution and the only way to know is to try so if you have questions and you want to register a hashtag hit me up i'm happy to help have a great day
