BuChE channel one of our most loyal youtube subscribers asked me a question on youtube is there much point trademarking a phone word 1-800 gut junk is a good example of a valuable company who did it would it give them much enforcement power against similar phone words or only the exact match that is the holdings company of the 100 gut jump trademark could stub the word being used if they lost the actual number from the company who actually owns it they trademarked it in Australia but the phone network provider Telstra actually owns the number I'm andrée binkham the father of trademark factory and here's my answer to this question well it's really several layers to this first let's talk about whether a trademark is the proper mechanism to be able to enforce against somebody who would register the same phone number as a number I would say it probably isn't especially since in theory you could just go out there and trademark other people's phone numbers perfect and then just use that trademark to go after them and claim their phone numbers that's not what trademarks are for and these identifiers are totally separate from one another is not like domain names especially since the same numbers can form different words right and because there is what three letters per number and in theory you know every combination every phone number can have multiple versions of what the phonetic the the word mark would be hiding under that number so short answer to that probably not probably you can't use the phone not only the trademark in the phone number to ground and get the actual phone number having said that there is still massive value in owning that trademark yeah everyone knows you under the bat brand yeah that's assume it has the phone numbers so 1-800 got junk is a great example so but they've been branding themselves as money how many got jumped another one is hundred flowers that's their brand it's not just a phone number so to them the problem would be not that somebody would get a phone number that's too close to theirs that they can do much about but let's say 188 got junk or 1-866 got junk or whatever but so let's say somebody else got that phone number because they're always opening up new numbers right the 800 number so he started with 800 then it became 88th and eight six six eight seven seven eight by five or four 53 and I'm sure they're going to be opening more and more and so at some point one eight hundred GOT JUNK may not grab the particular phone number with got junk in it so let's say somebody gets that number whatever the new world version of that phone number will be so they own it can want any how to got junk can't brian scooter more go after them let's say they'll know that's our tree look you can't have this not for no but as soon as the other company starts operating under that brand and they start draining themselves as well eight to two or eight four four got jumper 88 got junk and they have it all over their website and they have it all over you know the buses and that's what they're trying to get people to remember about them that would be a blatant case of trademark infringement not because they own the number but because they brand their business ask that it's something that's confusingly similar to a previously registered trademark so that's somewhat similar to the correlation between company names and trademarks you may not necessarily be able to stop others from calling their company a certain way but you can nail them through a trademark infringement lawsuit if they start using a name similar to yours that you have previously trademark and there's also the other issue here about jurisdictions because well us obviously 1-800 one stands for US or Canada but you mentioned Australia it could be 1-800 it has to be whatever the country code is for Australia and then something else and then got junk so they would have to do this on a per country basis if they really wanted to preserve this extraterritorial e in other countries but I don't know they did and but that that's that's a whole other layer of what's going to happen with Braham but to summarize you don't get a trademark to stop others from registering the phone number but you can use the trademark to stop them from heavily advertising products or services that are close to yours under that brand or slightly modified brand
