hello my name is juven dana i'm with dana legal services and in this video we're going to talk specifically about whether a u.s granted patent is enforceable in other countries to give you a quick answer the answer is no it's not it's only enforceable in the u.s if you want to enforce your patent in other countries there is a process by which you can take your u.s patent application and file it in other countries there are several avenues one avenue is called the patent cooperation treaty or pct you can take that route or you can go directly from the u.s filing into other countries there are timelines there are deadlines that you have to meet you can't just do it at any time you want there's typically a one-year window within which you have to do it so if you file your patent application in the u.s on january 1st 2020 then by january 1st 2021 you need to have filed your application in other countries if you are hoping to claim the priority date of the us filing which is january 1 2020. if you have any questions give us a call i'm juvent dana with dana legal services here is our contact info reach out and we'll be happy to set up a free consult to help you out take care

can a u.s patent stop somebody going overseas and uh making this product in china uh perfect question this is uh the short answer is no the u.s patent will not prevent somebody from making the product in china however it will prevent someone from importing the product into the united states so it doesn't matter where they manufacture it the u.s patent gives you a lot of protection because it stops imports into the united states if you want international protection we can do that as well it's not that expensive under different treaties you
